Attaining the US Permanent Green Card on an EB-5 Immigrant Visa Program

It is possible for qualified foreign investors to enter and stay in the USA under the EB-5 Visa Program. The enactment of what came to be known as Fifth Employment-Based Preference, or simply EB-5 immigrant Visa category law in 1990 by Congress made the possibility of business immigration a reality with the intention of creating investments advantageous to the US economy. Qualifications were set for applicants to be eligible; successful applicants were to facilitate the creation of at least 10 permanent placement jobs for US citizens. Furthermore, a caveat of proof of business capital of some $900,000 for investments in rural places or areas suffering high unemployment rates in the USA. Other places legally require 1.8 million dollars in investment capital. Every year some 10,000 Green card Visas are up for grabs by foreign Nationals.

The aim of the eb5 Visa Program attracts people intending to gain permanent residency status in the end, so it is a win-win situation for them and the US government. Winners receive an initial conditional green card allowing them and their immediate family residency for two years during which they enjoy maximum benefits similar to permanent residents. Hopefully, they will have established in an EB-5 Project investment creation criteria to apply for permanent status. They then become permanent green card holders if they pass the application, an assured way of possible citizenship at a much later time.

Luckily, after you get your green card through the EB-5 Program and migrated to the USA, pursuing to meet the conditions set do not tie you down to setting up a business or to reside in the same location as the business, You can identify and invest indirectly into an already existing entity that meets the conditional EB-5 immigrant Visa requirements. This is a flexibility aspect of the EB-5 Visa Program that is so attractive to prospective applicants.

If you have the interest to migrate as such, the process of getting an EB-5 Visa is simple; there are agencies that you can apply through and they will guide you step-by-step through the process appropriately as long as they have verified your eligibility for the Program. Generally, it is a four-step process lasting between 12 and 26 months. It consists of an initial preparation where you complete an investor questionnaire as you hand in requisite documentation. The second step is about petition filing by an immigration attorney. In the third step if successful you are awarded your green card to live and work anywhere in the USA. Finally, upon successful completion of the two-year moratorium, an immigration attorney files a petition seeking confirmation to permanent green card status. Application for citizenship can be made later, after 5 years of permanent residency. If you want to know more about this topic, then click here:
